AUDIOGALAXY SETTLES COPYRIGHT CASE
Audiogalaxy, the music-swapping website offering unreleased Eminem and Oasis tracks has been forced to settle with the major labels in the US before their case reached court. The site has been forced to remove all unlicensed tracks and pay a "substantial sum" to affected labels and publishers. The Recording Industry Association of America and the US based National Music Publishers Association reached the out of court settlement with Audiogalaxy earlier this week. The agreement is similar to one the RIAA made with Napster last year. It proved disastrous for Napster who found their subscribers deserted them once they went legitimate.

NUPHONIC LATEST
Leading downbeat/house label, Nuphonic Records, has confirmed it has ceased trading. The independent label started by Dave Hill and Sav Remzi in 1995, who have released titles from artists such as Norman Jay, Faze Action and Justin Robertson (previously Lionrock) have gone under. The label recently opened a bar in East London, The Bridge & Tunnel, which a source says will stay open, “the bar is completely separate from the label.”

AMERICAN BROADCASTING AUTHORITY BAND ‘REVOLUTION’
The American broadcasting authority, the FCC, is hoping to impose a $7,000 fine against non-commercial KBOO-FM in Portland, USA for broadcasting the 1999 album track, ‘Your Revolution’, a collaboration between Ninja Tune recording artist DJ Vadim and spoken word artist Sarah Jones. The commission claims that the track contains "unmistakable patently offensive sexual references." KBOO-FM counters that its mission is to provide a forum for "unpopular, controversial neglected perspective," and that ‘Your Revolution’ is "a feminist attack on attempts to equate political revolution with promiscuous sex" - the opening lyric is, "Your revolution will not happen between these thighs" - and thus is not indecent. The FCC has rejected that argument and has given the station 30 days to respond. The move has forced other non-commercial and progressive radio broadcasters to ban their programmers from playing the song. MANSON IN COURT OVER INDECENT BEHAVIOUR
Marilyn Manson has appeared in court and pleaded no contest to a count of disorderly conduct and assault and battery after he allegedly gyrated his genitals against a security guard at a concert in Michigan last year. The plead followed a reduction from the original charge of misdemeanor after Manson's lawyers convinced the court that the performer's crotch-rubbing was committed for shock value and not for sexual gratification. The judge slapped Manson with $4,000 in fines and court costs, but no jail time. Manson is now facing a lawsuit by another security guard who claims he was groined in the head by Manson during a concert at the Historic Orpheum Theater in Minneapolis. The plaintiff, David Diaz, said the incident caused him to "endure ridicule and shame." He's seeking damages for battery and emotional distress. And if that wasn’t enough to be getting on with, he Manson is also being sued for wrongful death by the mother of a woman killed in a car accident after coming home from a party at the performer's Hollywood home last year. The suit accuses Manson of giving actress Jennifer Syme, the ex-girlfriend of Keanu Reeves, "various quantities of illegal substances" that incapacitated her and caused her to crash her car into three parked cars. An autopsy later found cocaine in her system.

MEAN FIDDLER CONFIDENT LEEDS FESTIVAL WILL GO AHEAD
Although Mean Fiddler were refused a licence for the Leeds end of their Carling Weekender at the end of August, organisers have told nme.com that the event will go ahead. The Leeds venue is Temple Newsam Park. Last year's festival was marred by violence, with police in protective equipment required to control people throwing "stones and missiles" on the final night of the event. Trouble started after people in a festival campsite set fire to toilet blocks shortly after the end of the headline band at 11.30pm. Local pressure groups have been petitioning to block the festival – the Friends of Temple Newsam Park, residents and councillors have penned letters requesting the event be held in another location. Mean Fiddler’s Melvin Benn told NME that as soon as he received specific details of the local authority’s concerns his company would submit an appeal which he expected to win. "I've never failed to put a festival on in the past,” he said, “and I don't intend to start this year. If you have tickets, hold on to them, if you want to buy tickets, buy them. I'm 100% certain that the Leeds festival will take place this year. It's a great bill and a fantastic weekend. As ever the young people of Great Britain are having to stand up and prove themselves against adversity." The Leeds weekend, from August 23-25, is set to see a headline appearance from Guns 'N Roses, who are not scheduled to appear at the Reading end, with The Prodigy also billed.

METALLICA MAN IN COURT OVER BAND’S NEW NAME
Former Metallica bassist Jason Newsted is being sued by an unsigned Dallas band for copyright infringement over the name of his new act - Echobrain. The Texan act, Echo Drain, are suing for $1 million claiming Newsted's choice of band name causes 'confusion' among music consumers. The band also claim Newsted used the name in order to infringe on Echo Drain's rights and material, including pirating a song title for his band's eponymous debut album.

WESTWOOD CHAMPIONS UK HIPHOP
BBC Radio 1’s aging hiphop guru has described a new talent compilation he is involved in as an attempt to create a British scene to rival the US dominance. The DJ launched his quest in May, inviting new unsigned acts to send demos for inclusion on a special compilation album. More than 700 demos have been received and Westwood has selected six to go on the album. These will join 12 tracks by people "already out there in the scene but not signed to majors and not in the mainstream". Westwood continued: "UK record labels are not signing UK rap acts – they’re selling US rap to the UK and taking money out of the UK scene without investing anything back. This album is about acknowledging the tremendous wealth of talent out there and will, hopefully, act as a stepping stone for these artists to go forward." Acts so far chosen for the album include Funky DL, Mike GLC, Blemish Blackstorm, Ca$hino and 57th Dynasty. The compilation will be released through trustthedj Records on 29 Jul.
